Definition
This agreement is a contract signed between Orkay (ORKAY MÜHENDİSLİK HİZMETLERİ VE DANIŞMANLIK TİCARET LİMİTED ŞİRKETİ – Mersis No: 0524016374100063) and the users by downloading the Orkay application, navigating the system, registering to the system and benefiting from the services provided by the application, and which must be accepted unconditionally and unconditionally in order to use the application. is the text of the agreement.
Your rights regarding the processing of personal data of users who use the application and approve this agreement are also stated in the Information Text.
Scope
This Agreement applies to everyone who browses, registers, receives services and uses our company's website and application. Not being specifically defined in the contract does not exempt any user, natural or legal person from the contract.
General provisions
The User has allowed the Company to create a record for him/her by using all the information he/she gave to the site, including his/her CV containing his/her personal information, and to share this information with prospective customers. The legal, criminal, administrative or any other liability that may arise regarding the accuracy and legality of the information shared belongs to the sharer of the information.
As soon as the user uploads the CV to the application or site, including personal data, it will be visible to prospective customers who want to receive service from the application. In this case, the user irrevocably accepts that the information (personal data) in the CV will be made available to the public and especially to candidate customers and that Orkay has no responsibility regarding this data. Prospective customers who view CVs also accept, declare and undertake that they will handle this information within the scope of KVKK.
The user can remove his/her resume from the application at any time.
In this case, if the user wishes his personal data to be deleted, destroyed and/or anonymized, he will forward this request to Orkay in accordance with the formal conditions stipulated by the law. However, no requests can be made for the period until this request. You can refer to the Information Text to be informed about your rights regarding the processing of personal data, the processing and the consents required for this.
The prospective customer is responsible for the personal data obtained by Orkay's prospective customers.
Orkay has no obligation to investigate the accuracy of the information provided by the user and the information in the CV. The Candidate is personally responsible for the accuracy of these. Orkay can only be held responsible for the training he provides at his academy and the qualifications he approves.
The user accepts in advance that prospective customers can view all the information contained in this CV and provided in the application.
User's Communication Permissions
Orkay has the right to reach, call and send messages to the user for communication, new possible jobs, new training or other job-related purposes through the contact information specified by the user in the application and on the site or added by the user later. By using this application, using the site and accepting this agreement, the candidate accepts and declares that Orkay may engage in the above-mentioned communication activities towards him/her. The User may request the deletion of his/her membership record by giving written notification to Orkay in real or virtual environment. YOUR OBLIGATIONS
Every user who uses the site or application accepts the obligations listed below.
If Orkay suffers any damage in case of violation of these obligations, it may recourse to the user to compensate for this damage or to recover the amount of the damage it has repaired, or it may take legal action and actions to compensate for the damage. In addition, Orkay may suspend or close the user's account at any time by informing the user through the contact information shared in the system.
All personal data entered by the user into the application and/or site must be accurate and up-to-date.
If requested by Orkay, the user's personal data must be verified.
When there is a change or update in personal data, relevant parts of the user must be updated. Otherwise, the updated information in the system will be considered correct and in case of any damage, the user will be responsible.
The user's CV and the information or data entered on the site or application cannot contain statements that are misleading or inaccurate, defamatory of any third party, may violate the fundamental rights and freedoms of individuals, are unlawful, immoral or cause unfair competition.
The user cannot include personal data, especially sensitive personal data, of unrelated third parties, unless it is necessary and in accordance with the purpose of the site/application.
The user cannot make insults, slander, threats, etc., which can be considered a crime within the scope of the Turkish Penal Code No. 5237, on the site or application. Do not include illegal content, including content of can't The User cannot open more than one account for any reason and cannot allow others to use his account for his own benefit or for the benefit of a third party.
The user is responsible for sharing the data of the persons he refers to as a reference in accordance with the knowledge and consent of the relevant reference person and cannot avoid the legal and criminal liability arising from this.
